The software license agreement is displayed on the envelope so that you can read it before opening the envelope. Opening the envelope or use of the materials in this package will constitute your acceptance of the terms and conditions of the Software License Agreement. If you do not agree with the terms and conditions of the Software License Agreement, you may, within 30 days, return the package with an unopened envelope to your place of purchase for a full refund of all money which you paid for the product. No refund will be paid if this envelope has been opened.
1. Grant of License: In consideration of payment of the License fee, which is part of the price you paid for this product, Kaetron Software Corporation, as LICENSOR, grants to you, the LICENSEE, a non-exclusive right to use this package on a single Central Processing Unit at any one time and to copy the program, solely for backup purposes. You must place the same proprietary and copyright notices on any copies of the package as appear on the original. You may not electronically transfer it from one computer to another over a network, nor transfer, sell, assign, rent, lease, or distribute copies of the software to others.
2. Ownership of Software: As the LICENSEE, you own the magnetic or other physical media on which this package was originally or subsequently recorded or fixed, but Kaetron retains the title and ownership of the software recorded on the original disk and all subsequent copies of the disk regardless of the form or media in or on which the original and other copies may exit.
3. Copy Restrictions: This software and the accompanying written materials are copyrighted. Unauthorized copying of the Software, including Software that has been modified, merged, or included with other software, or made a derivative of, or of the written materials is expressly forbidden. You may be held legally responsible for any copyright infringement that is caused or encouraged by your failure to abide by the terms of this Agreement. Under the law, copying includes translating into another language or format.
4. No Reverse Compilation: You may not modify, translate, disassemble, or decompile the Software or any copy, in whole or in part.
5. Termination: The license is effective until terminated. The license will terminate automatically without notice from Kaetron if you fail to comply with any provision of this License. Upon termination, you shall destroy the written materials and all copies of the Software, including modified copies, if any.
6. Export Law Assurances: You agree that neither the Software nor any direct product thereof is being or will be shipped, transferred or reexported, directly or indirectly, into any country prohibited by the United States Export Administration Act and the regulations thereunder or will be used for any purpose prohibited by the Act.
7. Limited Warranty: Kaetron warrants to you, the original LICENSEE, that the disk on which the software is recorded and the accompanying written materials are free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of purchase. If the disk or written materials is defective, Kaetron will replace it at no charge to you, provided you have sent in your limited warranty registration card. The defective material must be returned to Kaetron at the address set forth at the end of this Agreement, with proof of purchase, within 90 days after you purchased it. Your sole and exclusive remedy, and Kaetron's sole and exclusive liability, shall be replacement of the disk in accordance with this limited warranty. Some states do not allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. You may have other rights which vary from state to state.
8. Limit of Liability: NEITHER KAETRON NOR ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY, OR LICENSING OF THIS PACKAGE MAKES ANY WARRANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SOFTWARE, OR ITS QUALITY, RELIABILITY, OR PERFORMANCE, OR ITS MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. THIS SOFTWARE IS LICENSED "AS IS". YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, RELIABILITY, AND PERFORMANCE OF THE SOFTWARE AND DOCUMENTATION. IN NO EVENT SHALL KAETRON OR ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY OR LICENSING OF THIS SOFTWARE BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, DIRECT, OR INDIRECT DAMAGES OF ANY KIND RESULTING FROM ANY DEFECT IN THE SOFTWARE OR ITS DOCUMENTATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Miscellaneous: This Agreement is governed by the laws of the state of Texas.
